These Guest Terms & Conditions (the “Guest Terms”) are a binding agreement between you (“Guest,” “you”) and HostMeals, a wholly owned subsidiary of Nink Inc. (“HostMeals,” “we,” “us”). They apply if you create an account, browse with intent to book, request a seat, pay for a meal (when payments are enabled), or attend any meal or cooking experience arranged through the Platform. They supplement the Platform Terms of Use and Privacy Policy.
BY CREATING AN ACCOUNT, REQUESTING A SEAT, CHECKING AN AGREEMENT BOX, OR ATTENDING A MEAL ARRANGED THROUGH HOSTMEALS, YOU AGREE TO THESE GUEST TERMS.
1. Marketplace; contract is with the Host
HostMeals is a marketplace that helps you discover independent Hosts. HostMeals does not cook your meal, does not operate the Host’s kitchen, and does not control the Host’s home. When a booking is confirmed, your agreement for the meal is with the Host, not with HostMeals. HostMeals is not a restaurant, caterer, or insurer of the experience.
2. Eligibility
You must be at least 18 (and the age of majority where you live) to book. If you bring minors, you are fully responsible for them, and you must only do so where the Host has agreed. You represent that your account information is accurate.
3. Assumption of risk
Dining and cooking in a private home involves inherent and unavoidable risks, including without limitation:
- foodborne illness, food poisoning, and contamination;
- allergic reactions and cross-contact with allergens in a home kitchen;
- slips, falls, burns, cuts, and other kitchen or household injuries;
- interactions with Hosts, other Guests, household members, or pets;
- theft, loss, or damage to personal property; and
- travel to and from the Host’s approximate or disclosed location.
YOU VOLUNTARILY ASSUME ALL SUCH RISKS. To the fullest extent permitted by law, you agree HostMeals has no liability for those risks or their consequences.
4. Allergies and dietary needs
If you have allergies, intolerances, or medical dietary needs, you must disclose them clearly to the Host before attending and confirm the Host can reasonably accommodate you. Home kitchens are not allergen-controlled commercial facilities. Cross-contact may occur. HostMeals is not responsible for allergic reactions or for a Host’s inability or failure to accommodate dietary requests. If you are unsure, do not attend.
5. House rules and respectful conduct
You agree to:
- follow the Host’s house rules and reasonable instructions;
- treat the Host, household members, other Guests, and property with respect;
- not harass, threaten, assault, or discriminate against anyone;
- not steal, vandalize, or misuse property;
- not bring uninvited guests unless the Host agrees in advance;
- not use illegal drugs on the premises; and
- comply with applicable law, including liquor laws if alcohol is present.
Violations may result in removal from the meal without refund (where applicable), account suspension, and reporting to authorities. HostMeals may cooperate with Hosts and law enforcement regarding alleged theft, violence, or other misconduct.
6. Property damage, theft, and disputes with Hosts
You are responsible for damage you (or people you bring) cause to a Host’s property, and for any items you take without permission. Disputes about belongings, deposits, behaviour, or meal quality are primarily between you and the Host. HostMeals is not liable for theft from Guests or Hosts, property damage, fights, or other interpersonal conflicts arising before, during, or after a meal.
7. Bookings, cancellations, and no-shows
Seat requests may require Host confirmation. Do not treat a request as confirmed until the Platform or Host indicates confirmation under our then-current process. Exact address sharing typically occurs only after confirmation. Cancellation and refund rules may be published separately; HostMeals is not responsible for Host cancellations, schedule changes, or meals that differ from descriptions, except as required by law or a written HostMeals refund policy.
8. Your own judgment and safety
You are responsible for evaluating whether a Host, listing, and location feel safe and suitable. Approximate maps are not a guarantee of distance, accessibility, or neighbourhood safety. Leave or decline to attend if you feel unsafe. Contact emergency services for emergencies—not HostMeals support channels.
9. Reviews
Reviews must be honest and based on your actual experience. You must not post defamatory, unlawful, or abusive content. We may remove reviews that violate Platform rules.
10. Release of HostMeals
To the maximum extent permitted by law, you release and forever discharge HostMeals and its affiliates and personnel from any and all claims arising out of or related to: (a) any meal, food, or beverage; (b) illness, allergic reaction, injury, or death; (c) property loss or theft; (d) disputes or altercations with Hosts or other Guests; (e) Host cancellations or inaccurate listings; and (f) your travel to a Host’s premises. This release does not waive rights that cannot be waived under applicable law.
11. Indemnification
You agree to defend, indemnify, and hold harmless HostMeals and its affiliates and personnel from and against third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your attendance at a meal; (b) your breach of these Guest Terms or law; (c) injury or damage you cause to a Host, other Guest, or property; (d) people you bring; and (e) your content or reviews.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTMEALS’ LIABILITY TO YOU IS LIMITED AS SET OUT IN THE PLATFORM TERMS (INCLUDING DISCLAIMERS OF CONSEQUENTIAL DAMAGES AND THE AGGREGATE LIABILITY CAP). WITHOUT LIMITING THOSE TERMS, HOSTMEALS IS NOT LIABLE FOR FOOD POISONING, ALLERGIES, THEFT, ASSAULT, OR OTHER HARM CONNECTED TO A HOST OR MEAL.
13. Governing law
These Guest Terms are governed by the laws of Ontario and the applicable federal laws of Canada. Disputes are subject to the jurisdiction provisions in the Platform Terms.
14. Acknowledgement
You acknowledge that you have read these Guest Terms, understand that HostMeals is only a marketplace intermediary, and agree that you attend neighbour meals at your own risk and that your primary relationship for the meal is with the Host.
